How Will Your Military Pension Be Affected
Your military pension is subject to the state laws where your divorce takes effect. California is a community property state. The portion of your pension (and future earnings) earned during the length of your marriage is subject to equal division in your property settlement. Most state laws permit divorcing military couples to establish a property settlement that allows the service member to retain the military pension in return for other fair property division.
